Amazon erred when it sued Seattle-based former real estate manager Carl Nelson in Virginia last year for violating his noncompete agreement, King County Superior Court Judge Michael Scott rule d. In addition to its claims of fraud, conspiracy and racketeering, Amazon contends Nelson violated the terms of his noncompete agreement by steering real estate deals to companies who had pledged to pay Nelson and his associates bribes and kickbacks through a complicated web of shell companies.
In court filings, Amazon has said noncompete restrictions protect its trade secrets, including its customer and business relationships as well as its “confidential plans, pricing, developments, and strategies.” Amazon’s attorney did not respond to questions.
Amazon also in 2019 lobbied Washington lawmakers to lower the salary cap under which the state ruled noncompete agreements are unenforceable from $180,000 to $100,000. The amendment allowed Amazon to continue enforcing noncompete agreements for most workers at its Seattle-area offices, who typically earn in excess of $100,000.
Nelson’s attorney, Shawn Larsen-Bright, also argued that Amazon had violated a year-old Washington law requiring employers to enforce noncompete clauses for Washington employees within the state.

Washington, D.C., Attorney General Karl Racine announced Tuesday he’s suing Amazon on antitrust grounds, claiming the company’s practices have unfairly raised prices for consumers and suppressed innovation.
Racine said his lawsuit zeroes in on the MFN clauses because he saw them as “a clear policy that results in higher prices to third-party sellers.”
Racine is seeking to end what he alleges is Amazon’s illegal use of price agreements to edge out competition; the lawsuit also asks for damages and penalties to deter similar conduct. The suit asks the court to stop what it calls Amazon’s ability to harm competition through a variety of remedies as needed, which could include structural relief, often referred to as a form of breakup.
The AG claimed these agreements ultimately harm both consumer s and third-party sellers by reducing competition, innovation and choice. Amazon requires third-party sellers who want to do business on the online marketplace to abide by its business solutions agreement.
An Amazon spokesperson said Tuesday in a statement: “The DC Attorney General has it exactly backwards — sellers set their own prices for the products they offer in our store. Amazon takes pride in the fact that we offer low prices across the broadest selection, and like any store we reserve the right not to highlight offers to customers that are not priced competitively. The relief the AG seeks would force Amazon to feature higher prices to customers, oddly going against core objectives of antitrust law.”
Amazon says it stores voice recordings to personalize and improve its software and that users can delete their records from the software . “Most people, when you tell them that Amazon records them for these purposes, are very surprised,” Lenkner said in an interview.
One merchant, who successfully pursued an arbitration claim after being booted from Amazon’s site, told Bloomberg earlier this year that the process took 18 months and cost $200,000 in legal fees.
It’s unclear whether Amazon will roll back arbitration clauses covering other areas of its business. The company still required third-party sellers and its gig-economy delivery drivers to file complaints via arbitration as of Tuesday, though some courts have declined to enforce Amazon’s requests for arbitration.
A few days after publication of the investigation, an Amazon Web Services senior manager named Charlotte Newman filed a lawsuit against Amazon and several current and former executives over claims of race and gender discrimination, as well as sexual harassment and assault. Newman said at the time that Recode’s investigation was one of the reasons she decided to speak out about her experience.
In one of the five suits filed on Wednesday, a 40-year-old Latina warehouse manager named Diana Cuervo alleges that a white male boss named Christopher Stoia repeatedly made racist remarks directly to her face.
The lawsuits come three months after Recode published an investigation that highlighted current and former corporate employees’ allegations that Amazon has a racial bias problem that particularly disadvantages Black workers. Recode’s story also revealed alleged racial disparities in Amazon performance reviews ratings, promotion rates, and the company’s corporate leveling system.
