Unfortunately, the Daredevil story represents another example of how a laypersonâs understanding of the legal profession digresses from actual practice. To be sure, letâs do a little, shall we say, legal analysis.
One of the coolest things that Daredevil can do is use his super-hearing to actually identify individual people by the sound of their heartbeat, much in the way most of us can tell who is speaking by the sound of their voices. In the comics, Matt Murdock often guessed superhero secret identities in this way, but always kept those secrets.

It's a fun moment that will really mean a lot to fans of Netflix's critically acclaimed Marvel shows. But it also represents one of the funnest things about Matt Murdock and Daredevil: He's a lawyer in a world of superheroes, so of course he represents superheroes.

Though Spider-Man's powers include super strength and his trusty Spider Sense, Daredevil can often match him with his sonar senses and years of training in hand-to-hand combat.
In short, a blind individual can enter the practice of law with relative ease and be more competitive with his sighted peers than ever before.
Foggy juggles both cases and ends up both the winner and the loser. Matt kind of gave up on lawyering and left Foggy holding the bag for all of season 2, so at the very least Foggy has the edge in experience and ability to actually show up and do his job.

Daredevil's ability to know if someone is lying using his heightened senses gives him an almost unfair advantage in the courtroom, though knowing someone is lying doesnât necessarily help him prove it. On the flip side, She-Hulkâs firm has far more resources than Nelson & Murdock, which could give her the advantage in a trial. Fortunately, Marvel actually provides an answer as to which lawyer would win in 2014âs She-Hulk #8 by Charles Soule. In this issue, Jennifer operates from her solo-firm, meaning she doesnât have the advantage of a larger firmâs resources. When a wrongful death claim is filed against the retired, old Captain America, Jennifer agrees to represent him, but the prosecutor is none other than Matt Murdock. Cap is eventually deemed innocent, after which he reveals that he wanted Matt to take the case against him because he wanted someone who wouldnât hold back. However, Steve chose Jennifer to represent him because he âdidnât want to lose,â showing that Cap ultimately has more faith in She-Hulkâs legal skills.

As a lawyer, did Murdock behave ethically? Decidedly not . He took on the representation of Healy even though there was a âsignificant riskâ that his representation would be limited by his responsibilities to numerous third parties (i.e., everyone he is trying to protect from Kingpin) and a âpersonal interest.â
One might counter: but, Murdock did get Healy acquitted! He represented him well in the courtroom, and only beat him up once the representation was finished!
In conclusion: while the âcriminal-defense-lawyer-by-day / crime-fighter-by-nightâ theme makes great narrative sense, it forces our hero to run afoul of many of the most basic ethical rules guiding an attorney. Matt Murdock has chosen his âhigherâ ethical obligation as vigilante over his professional obligation as an attorney. While we may love him as a superhero, the State Bar of New York would have no choice but to scold him as an attorney.
Vincent D'Onofrio probably provides the single best performance of any actor on Daredevil. His take on Wilson Fisk (aka The Kingpin) carries incredible gravitas and we fall for i hook, line and sinker-- except for this whole âI want to save Hellâs Kitchenâ routine he often spouts.

In the comic books, and even in the dismal Ben Affleck version of Daredevil, Matt Murdock often uses darkness to his advantage. After all, he can virtually see in the dark while most of his adversaries cannot. Itâs very common for him to use his billy club to smash lightbulbs, or even just flick off the switch in a room. In the Netflix series, he does this only a couple of times, allowing his foes to stage battles in areas where he has no leg up on them at all.
Obviously, they are allied in this war on crime, but at least in the comics, Punisher often uses âmercy bulletsâ which hurt but donât end lives. This moral contradiction for Murdock is blatant and hard to ignore.
Daredevilâs mentor is a mysterious old man named Stick. He is also blind, as well as an incredible fighter with an uncanny ability to beat people up. Along with Elektra, he trained Matt Murdock, whom he praises as one of his best students.
For those who know the publication history of Daredevil comics, itâs no secret that he wasnât exactly the most popular character in the Marvel bullpen. Multiple creative teams have tweaked his storyline from traditional supervillains to sci-fi type adversaries, and there was even a stretch of horror-like situations. It was only when the legendary Frank Miller took over that Daredevil became the character we know today: the gritty defender of Hellâs Kitchen.
evil, but a never-ending fight where you see some wins and some losses. When it comes to Daredevil, he tends to lose a lot more than he wins. Yes, he puts the Kingpin behind bars, but when he goes to confront Wilson Fisk in jail during season two, itâs very obvious Fisk is still building a criminal empire from prison. As mentioned, he does little to stop The Punisher, The Hand isnât really defeated, and Hellâs Kitchen still faces an incredible amount of violence.
As time goes on, he sees less and less value in his skills as Matt and more and more value in his abilities as Daredevil. He puts more time and energy into his Daredevil activities, leaving Foggy to act in his own daily life. Foggy is the one who excels at helping people out of costume, as he has no costume to lean on.
When it came time for Matt Murdock to tell his own story, he struggled to even know where to start. It was then that he turned to his best friend, Foggy Nelson. Foggy has overcome so much in his life, and, in the comics, only recently overcame Ewingâs sarcoma, a form of cancer.
The biggest and most obvious example of this, throughout Matt Murdockâs entire life, is the existence of Elektra Natchios. Even when they first met, while Matt and Foggy were still young men, Foggy could tell that Elektra was bad news.

Even after everything, itâs Foggy who knows Matt best, and it is Foggy who Matt trusts most to capture him in print.
