I think your problem is the driver had a suspended license. Likely, his insurance company will not pay as he was not a legally licensed driver. Is MA one of those states where even if the driver entering the highway ignores the yield sign, the driver going down the highway is obligated by statute to yield? IL is the only one I know of.
