The Supreme Court has not recognized the Sixth Amendment right to counsel beyond an initial direct appeal. This means that there is no guarantee that the condemned will eventually receive a good lawyer capable of convincing the reviewing court that the death sentence was a result of poor lawyering in the first place.

Both because there is a large backlog of cases and a limited number of courtrooms and judges to hear them, and the fact that the defense counsel often requires a large amount of time to prepare for and investigate the matter after criminal charges are filed.
The more issues, evidence, witnesses, and arguments, the longer the trial will take. While a legal case may seem interminable and the delays costly, the procedures in place are designed to protect both parties and produce the fairest system possible.Feb 27, 2015

Everyone is not entitled to representation. The US Constitution only provides for a right to an attorney in criminal cases. Legal Aid handles only civil matters. Before a case is accepted the case must be determined to have legal merit and meet Legal Aid priorities.
This means we have to review and counter every bit of evidence they bring forward, from videos to lab results (blood, DNA), witness reports and photos. This takes time, and the defense doesn't have control over the volume of evidence the prosecution produces.

At trial, Gideon appeared in court without an attorney. In open court, he asked the judge to appoint counsel for him because he could not afford an attorney. The trial judge denied Gideon's request because Florida law only permitted appointment of counsel for poor defendants charged with capital offenses.
The Double Jeopardy Clause in the Fifth Amendment to the US Constitution prohibits anyone from being prosecuted twice for substantially the same crime. The relevant part of the Fifth Amendment states, "No person shall . . . be subject for the same offense to be twice put in jeopardy of life or limb . . . . "
