Len Kachinsky. Photo from the Winnebago County Jail. The Wisconsin Supreme Court has suspended Brendan Dassey’s former lawyer from acting as a reserve municipal judge because of his unusual interactions with a court manager who accused him of harassment.
It is important to note that during Dassey’s first interview wherein he wrote a witness statement, the detectives had no reason to believe he was complicit in the crime and, therefore, would have absolutely no reason to pressure Dassey into making a false confession. To think differently is ludicrous.
The main evidence against Dassey is his multiple confessions that appear to be coerced, as investigators used leading questions and Dassey didn't have an adult supervision during the confessions. Dassey also had a reportedly low I.Q. and was only 16-years-old during the time of the confession.
Clear thinking people can accept that Brendan Dassey and Stephen Avery are guilty of the brutal rape and murder of Teresa Halbach. In fact, twelve of their peers have already come to that conclusion beyond a reasonable doubt. Justice was served.
Throughout the book, Cicchini provides extensive insight to readers, illuminating details of the case unknown to even dedicated viewers of the well-known documentary series. As is evident from the title, despite Dassey's conviction and failed appeals, Cicchini views Dassey as innocent and Dassey's confession as false.
August 2006: Kachinsky was removed from Dassey's case by Manitowoc County Circuit Judge Jerome Fox after he allowed Dassey to be interviewed by police without an attorney present. April 2007: A jury found Dassey guilty in Halbach's death. He was sentenced to life in prison.
Dassey's conviction was briefly overturned in 2016 – a decision that was upheld the following year by a three-judge panel in the Seventh District Court of Appeals. But following a challenge by the Wisconsin Department of Justice, the full seven-member appeals court voted 4-3 to uphold the conviction.

The court on Wednesday denied Avery's petition for review without commenting. Avery, 59, is serving life in prison for killing Theresa Halbach, 25, on his family's property on Halloween 2005.

In Sentence 2 Dassey wrote “I eat at 8:00 and I watch TV.” Dassey should have used past tense because he was describing a past tense event. Tense changes indicate deception. Dassey used past tense in Sentence 1 and in the sentences that follow the tense change supporting deception because Dassey broke his own baseline for using tenses.
Dassey used the pronoun “we” throughout the statement indicating that he willingly participated in the activities he described that Stephen and he did. This shows complicity on Dassey’s part and that he was a willing participant.
Dassey’s oral statement contains 26 information gaps, which indicates that he intentionally withheld information from his truthful story. Dassey told the truth but not the whole truth. Tense Changes. Interestingly, Dassey exclusively used the past tense when he described his activities in the truthful statement.
Most of the pronouns "we" were used to describe the actual rape and murder of Treasa Halbach. Dassey knew full well what he was doing. Missing Time. In his truthful statement, Dassey fills in the missing time when he wrote that at 7:00 he got a phone call from Stephen.
1) Between Sentence 1 and Sentence 2 – from the time he “seen her jeep” and until the time “I went into my house.”. 2) Sentence 2 from the time Dassey played Play Station 2 for about three hours until the time he “eat and watch TV.". 3) Sentence 2 from the time “I watch TV" until the time Dassey got a phone call from Stephen.
Liars must then convert the present into the past tense to make the story is believable. Because liars are under cognitive stress, they experience difficulties converting present tense to past tense and express supposedly past activities using present tense words. This phenomenon is called leakage.
Interestingly, Dassey exclusively used the past tense when he described his activities in the truthful statement.
After conviction, Dassey’s original appeals attorneys took his case to an intermediate state appellate court, the Wisconsin Court of Appeals. That court affirmed Dassey’s conviction in an officially “unpublished” opinion. The Court of Appeals gave deference to the trial judge and ruled that Dassey’s confession was voluntary because the police didn’t coerce him:
The defense called an expert to describe false confessions to the jurors and put Dassey himself on the stand. There, Dassey said he made up his confession. A defense expert testified about Dassey’s level of suggestibility (in other words, that the interrogators could have fed him answers).
The federal district court judge said that while the interrogators, Mark Wiegert and Tom Fassbender, did not mount “an intentional and concerted effort to trick Dassey into confessing,” their words and actions constituted a slowly wore Dassey down in a way that is not Constitutionally permissible.
From there, Dassey’s attorneys appealed to the Supreme Court of the United States.
The Wisconsin Supreme Court refused to take the case, leaving the language above as the crux of Dassey’s appeal to the U.S. Supreme Court.

In an email to the human resources manager, Kachinsky said the court manager should be advised to “give a little bit on the work-only thing,” and if she didn’t change her behavior, he had no alternative but to fire her. The village attorney responded with a letter telling Kachinsky his behavior constituted retaliatory conduct.
Kachinsky says he told the manager about his knowledge because he wanted her mother to know that her cellphone was broadcasting location information to others on Facebook.

Laura Nirider (LN): I first learned about Brendan Dassey’s case, believe it or not, when I was still a law student at Northwestern University Pritzker School of Law. I was a year away from graduation and decided to enroll in a wrongful convictions class taught by clinical professor Steve Drizin.
LN: The mandatory recording of interrogations is a crucial reform for which many organizations, including our Center on Wrongful Convictions of Youth, have joined the Innocence Project in advocating. In fact, a rule requiring juvenile interrogations to be videotaped was instituted in Wisconsin only a short time before Brendan was questioned, making his interrogation one of the first to be fully recorded under the new rule.
But mandatory recording, while an essential reform, does not ensure that the innocent will be acquitted; it simply ensures transparency. It is then up to attorneys to argue why the videotape shows a confession that was involuntary and/or false. Those arguments were not persuasively made to the jury in Brendan’s case.
Supreme Court review his case. Avery was found guilty of first-degree murder and illegal possession of a firearm in March 2007, and was sentence d to life in prison without the possibility of parole.
He is eligible for parole in 2048. Some fans of “Making A Murderer,” which became an instant hit following its release in December 2015, believe police coerced Dassey into giving a false confession.
