Sam has been a frequent lecturer on the law and legal practice at numerous law schools, bar associations, and community organizations. He is licensed to practice law in Michigan, Ohio, Illinois, Florida, and New York and serves as an of counsel, retired shareholder of the firm he founded.
He started his own private practice, Edward M. Bernstein & Associates, where he found most of his success. His law firm, started when Las Vegas was still a small gaming boomtown, and later represented many high-profile cases in Nevada, which brought about much of his regional fame.
Bernstein graduated from Long Island University in New York with his bachelor's degree in 1971. In 1975, he completed his J.D. degree from Widener University Law School. Bernstein moved to Southern Nevada in 1976, where he took a job in Las Vegas as a public defender.
Bernstein used this fame to champion many causes including MADD (where he introduced the first Red-Ribbon Campaign which garnered national attention later) and the Anti-Defamation League, The Cleveland Clinic Foundation, as well as the Clark County School District.

While Bernstein has not commented publicly on the matter, some speculate there was a shift in the "vision" and programming slate of the network when Discovery Channel President Jane Root was replaced by John Ford.
Josh Bernstein was born and raised in Manhattan, and attended the Horace Mann School. In 1989, he went to Cornell University where he double-majored in Anthropology and Psychology, and double minored in Native American and Near Eastern Studies. He served two terms as president of the Beta Theta chapter of the Pi Kappa Alpha fraternity. After graduating from college, he spent a year in a post-graduate program in Jerusalem studying, among other things, mysticism and ancient texts. He is Jewish. His father was born in Jerusalem 's Old City, and his paternal grandparents and great-grandparents are buried in Israel .
Bernstein's father died of a heart attack six weeks before Bernstein's 15th birthday. A year later, his three-year-old sister was killed in an automobile accident. Bernstein has an identical twin brother, Andrew. Bernstein is a fellow of The Explorers Club and the Royal Geographical Society.
