Rudolph Giuliani and Sidney Powell, attorneys for President Donald Trump, conduct a news conference at the Republican National Committee on lawsuits regarding the outcome of the 2020 presidential election on Thursday, November 19, 2020.
Howard Kleinhendler, an attorney for Powell, argued in the hearing that Smartmatic lacked standing, or grounds to sue her, because the Texas-based Powell didn’t make any of her disputed claims from New York.
Clement argued in the hearing that the claims made on Fox, by its hosts or Trump’s legal team, do not rise to the legal standard of defamation and are protected by the First Amendment . He also noted that guests like Powell and Giuliani were newsworthy figures discussing the biggest story of the day.
In the hearing Tuesday, Connolly told Cohen that Powell’s false election claims, and her posturing as an “avenging angel” who would reverse Biden’s win, were all part of a fundraising effort that raised millions of dollars.
Cohen then asked Kleinhendler to explain the basis for a slew of Powell’s claims involving Smartmatic, including that it flipped “millions” of votes and that its company handbook explains how to wipe away votes. Kleinhendler was unable to respond to some of the claims presented to him by the judge.
President Trump pardoned Flynn last month. Also in May, Fox News reported that now former acting U.S. Attorney for the District of Columbia Timothy Shea was also assisting with components of Durham’s investigation.
It is unclear, at this point, who those prosecutors are. Fox News reported in May that Jeff Jensen, the U.S. attorney for the Eastern District of Missouri who was tapped by the Justice Department in February to review the case of former national security adviser Michael Flynn, was helping with Durham’s investigation.
Boasberg gave him 12 months probation, 400 hours of community service, and no fine. Government prosecutors had been asking for Clinesmith to spend several months in jail, but Clinesmith's defense had been advocating for probation only. " [He] lost his job, and his government service is what has given his life much of its meaning," Boasberg said ...

Clinesmith in August pleaded guilty to "one count ...
Justice Department prosecutor Anthony Scarpelli called Clinesmith's crime, "incredibly egregious," adding that his actions have had negative consequences for, "The FBI, the DOJ, the FISC and the American public."
BARR APPOINTS DURHAM AS SPECIAL COUNSEL TO INVESTIGATE ORIGINS OF TRUMP-RUSSIA PROBE

Sidney Powell and Rudy Giuliani, once staples of Fox News, abruptly disappeared from the airways after Fox received legal warnings for their disinformation.
It was around that time, however, that Fox started receiving legal notices. The voting companies that Powell and Giuliani’s “ Kraken ” accused of stealing the presidential election weren’t about to take the allegations sitting down, and they sent a wave of legal threats to those involved.
Specifically, the lawsuit accused Scott of having "protected and promoted" Fox News president Jay Wallace, "despite the fact that he had a romantic relationship with a subordinate while he was still married."
Shortly after he was fired from Fox News in July 2020, Henry was accused of rape in a lawsuit filed by Jennifer Eckhart, a former Fox Business Network producer and online personality. The lawsuit also alleged that he retaliated against two women who rejected his advances.
Former Fox News host Ed Henry, who was fired in 2020 over a sexual misconduct allegation, filed a defamation lawsuit on Wednesday against the right-wing news network and chief executive Suzanne Scott. The lawsuit accused Scott of having “publicly smeared” Henry as a “sex criminal” when she released a statement saying he had engaged in “willful ...
Henry took issue with that given that the statement Scott and Wallace released when he was fired promised “full transparency” and noted that the network “strictly prohibits all forms of sexual harassment, misconduct, and discrimination,” the lawsuit states.
But, according to the lawsuit Henry filed, the matter was "intentionally covered up" by Scott.
Ty Clevenger, Henry's lawyer, said he expected to prove that Scott threw his client "under the bus to burnish her image as the tough female executive who cleaned up Fox News" while covering up for others at the network.
Henry, however, has not provided evidence to prove his claims.
But Gutfeld wasn’t the only one that seemed to enjoy mocking Williams on-air. Fox News star Tucker Carlson memorably ridiculed and belittled Williams during a Five segment, complete with his signature high-pitched cackle.
A former Fox News producer further elaborated, stating they were “very confident” that Gutfeld was behind Williams’ exit. A current staffer also added: “ [Gutfeld’s] been wanting the show back in the studio for quite some time.”
Besides having near-daily shoutfests with Williams during Five broadcasts, Gutfeld was also outspoken both behind the scenes and on the air about his desire that the program fully return to the studio.
Since then, left-leaning voices have very rarely appeared on the show while the network named former Trump press secretary and known liar Kayleigh McEnany as one of the program’s permanent co-hosts.
Furthermore, Gutfeld and Williams rarely ever spoke with one another off-set, going to great lengths to avoid interacting with each other, something both former and current Fox employees could attest to.
