As it states in their policy, your attorney is required to discuss your case with USCCA. The problem with this is, it is unethical for a lawyer to be directed in the representation of a client by a third party. In addition, even if they do provide an attorney for you, USCCA is going to entirely control the coverage.

You do NOT have to choose an attorney before you have an incident and I cannot guarantee youâll get your attorney for the initial response to the self-defense incident (time of day, vacations, illnesses, location, etc. all can play into that). But you can use your attorney for the rest of your defense. Hope that helps!

A general practitioner, or an attorney who handles multiple areas of law in the course of his or her ordinary practice, may be a fine choice for a real estate closing but will almost certainly be the wrong call for anything in a criminal case or major lawsuit.
While finding the best hired gun is going to be important for getting the best result, it is important not to lose track of the fact that this is a person with whom you will be communicating a lot over the course of your case.
Usually, by the time you need an attorney, especially after an arrest, you are already far behind the eight ball. Take some time now â and I mean right now â to do some research on qualified attorneys in your area. Then write them down. Keep in mind that you may be behind bars and unable to participate in the search for your attorney.

USCCA membership covers two main categories of protection and they are liability protection from a civil suit and criminal defense protection for when you are charged with a crime. USCCA also provides legal guidance on the right way to resolve the situation for both types of scenarios.
As a member of the organization, USCCA provides you with criminal defense protection of up to $2,000,000 depending on your policy that includes the cost of a criminal defense, including lawyerâs fees, investigation, and court fees.
However, if you do end up being convicted of a crime, USCCA will cease all payments. The policy also states that the organization will pay any necessary bills immediately and you do not need to reimburse or repay any money that you or your lawyer have received from USCCA. When it is not a self-defense scenario.
Of course, every self-defense incident may not necessarily be considered as a crime, and the conclusion is only made once a judge or jury has made a ruling.
As with most forms of insurance coverage, there are several scenarios where USCCAâs liability and criminal defense protection will not apply. For those looking for concealed carry insurance, it is important that you read the policy yourself and get a good understanding of what is and isnât covered. Here are a few key scenarios that are not covered by USCCA:
Training and Resources. It is often more important to avoid a fight than it is to win a fight, and this is especially true when it comes to a gunfight. Fortunately, USCCA CCW insurance provides its members with a good library of training and resources to help you avoid fights and what to do if you do get into one.
If youâre prosecuted and stuck in court for trial, it is likely that you wonât be able to continue working. A court trial can last for weeks and even months, this can put a serious strain on your finances. Knowing this, it is important to find a CCW insurance company that offers per diem which is a daily allowance while youâre in trial. While some CCW insurance options do not offer anything, USCCA pays an impressive $750 per day to lighten the financial load on you and your family.
All USCCA Attorney Network attorneys chose to join and support our members and to be a part of an exclusive community of attorneys that are committed to defending the rights of responsible gun owners across the nation.
If an attorney is not listed in your area, we advise you to contact a few firms close by to ask for a recommendation. Or, you can consult with your state bar association, ask friends and family for recommendations, or visit other websites such as www.findlaw.com.

Even if you do receive coverage from the USCCA, if you get convicted of a crime, your coverage with USCCA ends!
Picking your own attorney is important because you should be able to get the best representation to keep you out of jail. According to their policy, if your lawyerâs strategy doesnât match with what the USCCA wants or your lawyer charges more per hour than what the USCCA will pay, then you canât use that lawyer.
Letâs look at the statistics, about 95% to 98% of all criminal cases end in a plea. You could be charged with first-degree murder and accept a plea to lower charges â but doing so, ends your coverage with the USCCA.
What this means is, if the shooting is not found to be a self-defense shooting, you are most likely going to be charged with a crime. If that happens, USCCA is not required to cover you. Most people think they are purchasing coverage from USCCA in the event they must use their firearm, but there is no coverage if you are found not to be acting in self-defense. So, if you think that you are purchasing the USCCA Plan because you want coverage if you are charged with a crime, theyâre specifically telling you right in their contract, there is no coverage for a criminal act.
Overall, I think the USSCA is great for training and insurance purposes, but if you are looking for legal protection, you may want to think twice about getting their Self-Defense Liability Insurance. What they donât tell you about their plan is that if you ever get charged with a crime, you wonât be covered by the USCCA program.
Under their policy, the USCCA reserves the right to come after you for all costs and money they paid to defend you if you get a guilty verdict.
100% of your attorneyâs fees are covered in Arizona, Hawaiâi and self-defense is reasonably claimed as a defense
The moment after you use your firearm for defense, you must contact the authorities as soon as possible, if they havenât arrived already.
For one thing, your plan will cover the lawyer retainer fee from $2,500 up to $100,000, depending on the level of membership that you select.
This is a major concern you may have, but the truth is yes, the USCCA is perfectly legitimate and on their website you will find an impressive collection of articles written by expert writers from all over the country. They also produce a magazine that serves as a rival to pretty much any other gun/ 2nd Amendment /CCW related magazine thatâs out there.
USCCA will also provide you with a self-defense expert witness who can testify for you in court. The defense attorney they provide to you will also be an expert on self-defense laws both nationally and in your state.
A major benefit to the USCCA is how it will cover your up front costs, which is something that many CCW plans wonât do as they reimburse you after the court battle. With USCCA, your fees are paid to you on an ongoing basis. USCCA will also provide you with a self-defense expert witness who can testify for you in court.
Should charges be pressed against you, you will go to court and the legal fees will really begin to accrueâŚand itâs when youâll really be glad you had the insurance.
You will most likely be handcuffed and taken to the local jail. Do not answer any of their questions and remember you have a right to remain silent. Anything you say can later be used against you. Once you are allowed to make a phone call, call USCCA (their number should be on your card) and explain what happened.
There are currently three tiers of USCCA membership: Gold Membership: $25/month (annual) or $29/month. Platinum Membership: $34/month (annual) or $39/month.
