A movie on the Batla House encounter has been made that stars John Abraham in the role of Sanjeev Kumar Yadav, then-inspector who is now a DCP posted with Special Cell who was one of the first people to reach at the encounter location after the suspected terrorists were found. Sanjeev Kumar Yadav was put under the scanner when theories of it being a fake encounter were doing the rounds.
Furthermore, the caretaker of the house Abdul Rehman and his son Zia Ur Rehman who went to the police station voluntarily to show the copy of police verification of the house were also arrested on charges of forging the rent lease agreement and framing the blasts respectively.
To prep up for his role, John Abraham spent time with Special cell DCP Sanjeev Kumar Yadav in order to understand the incident.
The court also couldn’t find any evidence to support his involvement in the case. After three years of trial and 77 witnesses, he was sentenced to life in 2013 with fine of Rs 95,000. He was accused of killing Sharma, attempting to kill other officers and destructing the evidences.
On the other hand, in his statement, Shahzad said, “I am innocent and have been falsely implicated in this case… I never made any disclosure statement. My signatures were obtained forcibly and same were fabricated by the police. I was picked up by officers of Anti Terrorism Squad Lucknow from my house (in Azamgarh). A complaint in regard of kidnapping was also lodged,” he said.
After a year, one of the two suspected terrorists Shahzad was picked up from Azamgarh in Feb 2010. While the police said that he was discovered on the basis of the passport that was recovered from Batla House, the details in response to an RTI did not mention of any passport. The police, however, blamed the sloppy paper work for this.
Shahzad’s sister said that her brother was falsely implicated and that he was innocent. She said she would fight for justice. In 2014, Delhi High Court accepted his appeal against the conviction and the trial is on.
The Batla House encounter dates back to September 19, 2008, during which two Indian Mujahideen terrorists namely Atif Amin and Mohammad Sajid were neutralised. The terrorists had been hiding in a locality in Delhi’s Jamia Nagar, after killing about 30 people in Delhi serial blasts. When the Delhi police received intelligence reports about their hideout, they ambushed the locality leading to the encounter of the two terrorists. Three others, including Ariz Khan, managed to escape the law enforcement before being nabbed in 2018.
Recently, Law Minister RS Prasad hit out at both Mamata Banerjee and Arvind Kejriwal for casting aspersions about the 2008 encounter. He said, “The Samajwadi Party, BSP, Congress, Left and Mamata Banerjee made the Batla House incident a national issue. What does this mean? Will our fight against terrorism be weakened for votes? Today, after more than 100 people testified and scientific and medical evidence led to the conviction of a big terrorist in the case, will these parties apologise.”
Salman Khurshid, a senior Congress leader, in one of his rallies during the 2012 Uttar Pradesh Assembly elections, had said that Sonia Gandhi, the then Congress President cried bitterly after seeing the images of the slain terrorists.
Khurshid had said, “When we showed Sonia Gandhi the images of the ‘incident’, she started crying bitterly and with folded hands, she said please do not show me these pictures. Immediately go and speak to the Wazir-e-Azam (Dr Manmohan Singh) and discuss the mater. I talked to the PM and it was decided that the matter will be further investigated.”
Singh, who had been demanding a judicial probe in the Batla House encounter, said, “I have not seen the court order nor am I one of the parties in the case. The parties in the case can accept it or appeal against it. It will be their decision.”
In a major development on Monday, terrorist Ariz Khan convicted of murdering Delhi Police Inspector Mohan Chand Sharma during the Batla House encounter was awarded the death penalty by a Delhi Court. The same court had pronounced Ariz Khan guilty on March 8, asserting that the prosecution had successfully proved the case.
While addressing the media in July 2013 during his visit to Indore, Congress heavyweight leader Digvijaya Singh refused to apologise to the BJP over his claims that the Batla House encounter was fake. Singh stated, “I will never apologise. I still maintain that encounter was fake.” He further reiterated that those unhappy with the verdict in the Batla House case can appeal to the Court.
However, G-23 leaders rubbished such claims and recalled how Smt. Sonia Gandhi had wept tears of agony following the Batla House Encounter. The conviction of Ariz Khan in the matter has drawn a similar response from the head of the Congress party, they say.
Salman Khurshid , meanwhile, is untraceable in all of this. Readers would recall that it was Khurshid who had informed the nation that Sonia Gandhi had wept profusely over the Batla House Encounter. Sources close to the parivar confided in us that until then, even Sonia Gandhi was not aware that she had cried profusely over the same.
Some claim that she is upset because it is a major blow for the party ahead of the crucial elections in five states.
