Revenue to support indigent defense is provided through a combination of court costs, surety bond fees, juror pay collections, and state bar membership fees. The Texas Indigent Defense Commission (TIDC) is appropriated an estimated $71.1 million in All Funds for the 2016–17 biennium.
133.002(2) defines indigent: “an individual who earns not more than 125 percent of the income standard established by applicable federal poverty guidelines.” The Department of Health and Human Services (HHS) updates and publishes federal poverty guidelines in the Federal Register.
