You have the right to fight your own cases without engaging any advocate. It is not necessary that you must engage an advocate to fight your case in a court. Many â most â attorneys representing Veterans have dedicated their lives to change the law for Veterans, to bring justice and due process to a benefits system that is largely dominated by what Veterans perceive as greed, cronyism, and enough red tape to gift-wrap the planet Mars.
Iâm out in the trenches representing our nationâs Veterans every day â watching them struggle to live, and watching many of them die.
However, veterans represented by attorneys have the lowest denial rate in front of the BVA, at 14.8 percent, well below the average 20.3 percent denial rate, according to the Board of Veteransâ Appeals Annual Report Fiscal Year (FY) 2020.
The process, while complex, is sympathetic to claimants at the agency level, meaning that VA must read claims and appeals in the broadest way possible to ensure that veterans receive the most benefits to which they are entitled. Veterans with attorneys who have extensive knowledge of the claims and appeals process are the best suited to take advantage of this sympathetic environment.
