May 15, 2011 · Greet your attorney. By way of introduction, write out a phrase greeting your attorney by his last name. For example: "Dear Mr. Jones" or "Dear Ms. Fisher" Position the greeting on the left side of the page. Follow the greeting with a colon, i.e. "Dear Ms. Fisher:"
To write a letter to your attorney, start by writing your address, and, if applicable, your email and cell number in the upper left corner of the page. Under this information, include the date and your attorney’s name and address. Finally, include your case number or your full name.
If you are concerned your lawyer is not working on your case, write him a polite but firm letter explaining your concerns. If you feel more comfortable emailing or calling him, that would be fine as well. You are under no obligation to express your concerns in a formal letter.
On the left side of the page, directly beneath your address, write the date of the day you are writing the letter. The date should be placed on the left regardless of whether you are using full block or modified block format. Write the date in word rather than number form, as in June 8, 2015 instead of 6/8/15.
At some point while your case is pending your lawyer may wish to engage in plea negotiations with the prosecuting attorney. There are many ways such negotiations may transpire. One option would be for your lawyer to write a letter to the prosecuting attorney stating the many reasons why a reduction in charges would be appropriate.
Sentence negotiations are between your lawyer and the judge whereas plea negotiations are between your lawyer and the prosecutor. The reason for this demarcation is the separation of powers. Enforcing the law is the duty of the executive branch of government, and like police officers, prosecutors act in the capacity of law enforcement.
Format – whenever possible, character letters should be in business block format, on the author’s letterhead, and include a date, an inside address, including an email address, and a telephone number.
