Woolverton packed the back seat of his car with ice cream samples stored in dry ice. The dry ice helps to keep the ice cream from melting. However, as the dry ice evaporates, it releases carbon dioxide. While stuck in a traffic jam, Woolverton had trouble breathing. He was soon hyperventilating and close to fainting.
A pint of vanilla-flavored Halo Top contains just 70 calories and 2 grams of fat compared to 137 calories and 7 grams of fat for regular ice cream. While experimenting with recipes, Woolverton discovered that people canât really detect minor differences in fat content.
Ice cream manufacturers tried to tell Woolverton that his formula wouldnât run through ice cream production pipes. He ignored their advice and found an ice cream maker that would try his recipe. The thick formula started passing through aluminum production pipes and quickly jammed the machinery.
As with a wide range of successful entrepreneurs over the past decade, Justin Woolverton didnât have direct industry experience. He wasnât part of the dairy industry, but he was an ice cream connoisseur. The story starts in 2011 with Woolverton working at the LA law firm Latham & Watkins.

Todayâs food environment can be difficult to navigate. In grocery and convenience stores, marketers cover their products with label claims (e.g. low-fat, good source of whole-grains, natural) that can confuse consumers ( Benton, 2015 ).
We recruited two hundred and forty people for the study at the local winter farmers market and outside the cafeteria at a large medical center in Burlington, Vermont. Researchers asked people passing by if they wanted to participate in a five- to ten-minute study, and those who accepted were offered an informational document about the experiment.
Two-hundred and forty individuals participated in the study. Eighty-one participants were in the no-label information condition, eighty-one participants were in the label-information condition, and seventy-eight participants were in the label-informationâŻ+âŻhealth-warning condition.
Information conditionâwhether participants received no-label information, label information, or label information and a health warningâdid not impact ice cream liking. The majority of people in every condition preferred the super-premium Ben & Jerryâs ice cream followed by the vegan Ben & Jerryâs, with Halo Top the least preferred.
The results of this study suggest that although low-calorie ice creams may be rated as healthiest, they receive lower liking ratings compared to vegan and super-premium ice creams. Consumers are also more likely to prefer the super-premium ice cream regardless of whether they see nutrition-label information or not.
