Avery's current lawyer, Kathleen Zellner, named Bobby Dassey and Scott Tadych as possible suspects for Teresa Halbach's murder in Making A Murderer Part 2, but Avery's first lawyer, Jerry Buting, said they had the names picked out ...
Avery is behind bars for life, and Dassey has the same sentence with eligibility for parole in 2048. Avery was priorly found wrongfully convicted of a past crime and has spent much of his life in prison. Buting said both men are innocent. "I said this before.
Buting spoke of the theory, which claims Tadych and Dassey may know more than they've revealed. According to Buting, his team was unable to name the pair in under Wisconsin's Denny Law. "We filed a motion for third-party suspect evidence, also known as the Denny Motion in Wisconsin, and we named a number of people who had access to her and you know could have had the opportunity and access to have been the killer or killers," Buting told Newsweek. "The judge would not let us name or point a finger at any of those people because he ruled we could not prove that any of them, including Bobby and Scott, had any kind of motive. Now we did in fact named Bobby and Scott as possible suspects."
Despite the overwhelming evidence many people believe Steven Avery is innocent. This is because in 1985 Avery was convicted of sexually assaulting a woman. He spent 18 years in prison before DNA evidence exonerated him and he was released. Avery then sued Manitowoc County. It was in the midst of his lawsuit that he was arrested for Halbach's murder. Some believe his conviction for her murder was payback for his lawsuit.
Conclusion. A miscarriage of justice did occur in 1985 when Steven Avery was convicted of a sexual assault that he did not commit. But I do not see a miscarriage of justice in his 2007 conviction for the murder of Teresa Halbach.
People's words will betray them. Avery makes a huge blunder in how he phrases his answer. Yet, it goes unnoticed. People don't pay attention to what he is saying. A good interviewer or a good reporter would have challenged him on his language by asking more questions. Avery would then either confess as to what happened or he would tell more lies which would be very apparent.
Avery denies Halbach was in his residence. Avery's statement, "That's about it" clearly tells us he is withholding information. He has not told us everything that happened that day. When analyzing a statement, it is also important to look at what the person has not said.
More importantly is Avery's explanation for why he thinks Dassey's confession is false. It is because, "There ain't no evidence to back it up.".
Because of the public interest created by this documentary, as of this writing an online petition calling for a Presidential pardon of Steven Avery has over 200,000 signatures. The prosecutors state there was no misconduct in regards to the investigators working the case; that the evidence speaks for itself.
Avery then talks about Halbach's actions. This is important because he was not asked about what she did. Everything a person says has a meaning.
The presumption of innocence applies to us all in a criminal proceeding. It is the job of the prosecution to convince the jury beyond a reasonable doubt of guilt. The accused is innocent until the jury renders its verdict. 4. The defense investigator made a valid point which bears repeating.
He sexually abused a young female relative. The police knew all of this and that is why he was a suspect in the initial rape case. He was taken in for questioning and then was chosen out of a police lineup by the victim, wrongfully....but the police were trying to solve a crime and Avery was a viable suspect.
Steven Avery was convicted for a crime he did not commit but that does not mean he would never commit one. In fact, his crimes pre-prison show he was escalating to murder. It was probably just a matter of time. Learning about that murder from Making of a Murderer is like learning about 9/11 from Loose Change.
