If the facts are as you say then you have two possible courses of action. You can contact the Court and file your complaints or contact the state bar association and file a complaint.
Maybe you should take responsibility for yourself. The Court sends subpoenas so you probably signed for one or one was mailed to you and you missed it. Also, your smart enough to get online and complain about your "court appointed" attorney.
Notify the court about this. It is a violation of the Rules of Professional Conduct for an attorney to not return calls from clients.
If your lawyer fails to handle your case competently, including intentionally ignoring you or by being too busy to work on your case, you may be able to take action through a legal malpractice suit. Poor communication alone is not grounds for a legal malpractice suit, but if your attorney stops working on your case altogether it could escalate to a malpractice suit.
To end the relationship, send a written letter, preferably certified with a return receipt requested. The letter should explain your concerns with the lawyer’s inattentive behavior and request a complete copy of your file.
Lack of communication is one of the leading reasons clients choose to seek a new lawyer. While lawyers are often busy attending court, meeting with other clients or preparing a case, persistently failing to return calls or emails can damage the relationship and case beyond repair.

Before terminating your relationship with your attorney, read your retainer agreement. The retainer agreement serves as a contract for services between you and your lawyer. It should clearly define the terms of your relationship and what happens if you chose to end it.

There could be a variety of reasons your public defender hasn't been able to speak to you from being sick, to being in trial to being overloaded with other cases. Yes, you can have another pre-trial date and I suspect yours will be continued to give you an opportunity to meet with your attorney. Just remember that a judge will not force you to go to trial or give up rights if you...
The public defender has a duty to stay in communication with you and help you on your case. It's likely that they will set up a private meeting with you at the pretrial hearing. A continuance of your case is likely to allow both you and your lawyer to have time to discuss the case, formulate a defense, and prepare for trial...
Most public defender offices have "conflict" defenders. However, a conflict is not about time spent with the defender. Usually this is reserved for cases with multiple defendants on the same case.#N#I'm often asked what the difference is between hiring private counsel and using a...
A public defender has the same obligations to represent a client as an attorney you may hire. If the public defender is not doing his job, you could always hire your own attorney. Otherwise, you husband could bring the matter to the attention of the court arguing that he is receiving ineffective assistance of counsel. Report Abuse.
Public Defenders do have tremendous case loads and normally do not have the time to spend with their clients that either they or their clients would like. However, they are expected to keep their Clients informed off any and all progress and to at least be familiar with the case and what's in the police reports, etc.
If you are unhappy with PD even after attempting to fix that relationship you may be forced to seek a differenct attorney. The court may permit PD to withdraw if attorney client relationship has deteriorated to such a point that there is no trust. Sadly court may appoint a contract counsel who may or may not be more involved. If you have no funds that is your best option. If you have funds to hire private counsel find the best in the area and make an appointment to meet. I routinely meet with folks incarcerated and am sure any competent defense lawyer in your area would do the same. Good luck.
If the court refuses to appoint new counsel and you remain adamant that your lawyer is unacceptable, you could file a complaint with the state bar organization. This complaint would cause an immediate conflict of interest between you and your attorney and would require your attorney to ask the court to appoint a replacement.
If you are dissatisfied with your lawyer, your first step should be to raise your concerns in a conversation. If the problem persists and your lawyer is a public defender, you may contact the lawyer’s supervisor. In rare cases, the supervisor may assign a different public defender. This would be done without court intervention.
Updated: Dec 15th, 2020. The Sixth Amendment guarantees the right to the assistance of legal counsel in all felony cases. If a person does not have the financial means to hire an attorney, courts will appoint a lawyer free of charge in all cases, including misdemeanors, that have the possibility of incarceration.
At a hearing in which you ask for a new lawyer, the courtroom is typically closed to all but the judge, the defendant, and the appointed lawyer, and the record of the proceeding will be sealed. This means that neither the prosecutor nor the public will have access to a transcript of the proceeding. The defendant presents his grievance, the defendant’s lawyer responds, and the judge normally asks questions to clarify the dispute. The judge will attempt to resolve the disagreement without having to appoint a new lawyer.
If you're claiming your public defender is failing to communicate with you, you'll need detailed support showing a lack of communication over a substantial period. Bring documentation such as records of unreturned phone calls, canceled meetings, or missed jail or prison visits.
Although any one lawyer might be better than another, the general assumption that private attorneys are better than public defenders is not true. Consider the following: Most public defenders are committed to the cause of justice and want to help you get the best result possible.
As defined by ethical rules, a lawyer's duty to keep clients informed has two primary components: to advise the defendant of case developments (such as a prosecutor's offered plea bargain or locating an important defense witness), and. to respond reasonably promptly to a defendant's request for information.
The duty to keep clients informed rests on attorneys, not clients. But on the theory that if the attorney screws up it's the client who usually suffers, here are a couple of steps that defendants can take to try to secure effective communication with their lawyers: 1 Raise the issue early on. Establish, in advance, a clear understanding about case updates. If an attorney's practice is to initiate contact only when a development occurs, the attorney should communicate that to the client at the outset of the representation. If a client wants (and can pay for) regular updates regardless of whether developments have taken place, that too can be spelled out in advance—even included in a written retainer agreement. 2 Be reasonable. A defendant who phones his or her attorney with a request for information can indicate a willingness to speak with the lawyer's associate, secretary, or paralegal. The lawyer may be too tied up on other cases to return the call personally, but may have time to pass along information through an assistant. And because some lawyers have poor communication skills, the defendant may be better off getting information from an assistant than from the lawyer.
